合同的尾部和合同中的一些翻譯問題

合同的主體部分我們已經(jīng)講解完了，今天我們來看一下合同的尾部（end）。

尾部包括合同的備注說明，簽約雙方的簽名，有效期，法規(guī)依據(jù)等內(nèi)容。比如：this contract shall come into effect after signing by both parties. this contract is made out in two original copies, one copy to be held by each party.
本合同經(jīng)雙方簽字后立即生效。一式兩份，雙方各執(zhí)一份。

簽約雙方的簽名通常要在雙方約定的所有條款下方，這樣才表示雙方對所有條款都認同，否則就表示雙方只認同簽名以上部分的條款。通常，在簽字的時候，不僅要有打印的字體，雙方還要有手寫體的簽名。

翻譯合同時還有一些常用的詞組，這些詞組和我們平時所用的有些不同。我們看看下面這些例子：

1. 盡管：在合同中我們通常使用notwithstanding

2. 依據(jù)：according to; in accordance with; under; subject to; as provided in; ...

3. 鑒于：hereof; hereto; herein; hereby; hereinafter; hereunder; whereby; whereas; ...

4. 因為：because of; on account of; due to; attribute to; by virtue of; ...

5. 保證：undertake to; represent and warrant; guarantee; warrant; ...

6. 有義務(wù)做：be obliged to do sth.; have the obligation to do sth.; shall; be responsible / liable for

7. 完成：effect; ...

此外，對于合同的翻譯，還要注意：
1. 詞序變化較大，尤其是狀語的變化；
2. 使用短語代替從句，應(yīng)注意結(jié)構(gòu)緊湊；
3. 善于使用被動語態(tài)；
4. 使用否定前提來強調(diào)。
